Aircraft Rental Agreement
In consideration of the covenants herein contained, Gorge Winds Aviation, Inc., the “Operator”, hereby leases to the undersigned “Renter”, upon the terms, covenants and conditions, herein set out, the aircraft designated on reverse side, hereinafter referred to as “aircraft”.
- Renter acknowledges and agrees; that the aircraft is the property of the Operator, that he has inspected the aircraft and has found it in good mechanical condtion.
- Renter will return the aircraft at agreed time, weather permitting.
- The aircraft will be properly secured when not in use.
- Renter expressly acknowledges personal liability to pay Operator on demand.
- Service and time charges computed at the applicable rate specified hereon until said aircraft is returned to location specified hereon.
- Any loss or damage to the airplane, or its parts or equipment during the rental period.
- The amount of any parking tie-down, or hangar charges, or any other charges until the aircraft is returned to Operator at location specified hereon.
- Renter agrees not to tamper with, molest or attempt to repair any part of the airplane, or its accessories but will telephone Operator collect for instructions.
- If the airplane is abandoned away from the home base airport, Renter will be charged pilot’s expenses plus flight time at dual rates to return the aircraft to home base.
- Renter agrees to report all accidents, major and/or minor to the Operator as soon as practicable after the accident.
- Renter agrees that said aircraft shall not be used or operated: (a) for any illegal purpose; (b) in any race, speed test or contest; (c) by any person other than renter who signed the agreement; (d) Outside the limits of the Continental United States; (e) to carry passengers or property for a consideration.
- Renter agrees that in the event suit is instituted by the Operator to recover possession or to enforce any of the terms, covenants, and condition hereof, or to collect any sum or sums of money, damages or costs, the Renter agrees to pay all costs and reasonable attorney’s fee incurred by the Operator in such suit or suits.
- Renter by affixing his signature hereon does agree to follow the published Flight Safety Rules and acknowledges posted insurance provisions.
Rules
- Pilot certificate – Renter must hold a valid and current pilot certificate with appropriate rating(s). The renter named on the rental contract shall be the pilot in command and will be responsible for the aircraft at all times.
- Currency – Renter must possess evidence of a current biennial review and medical certificate.
- Preflight – Renter will personally conduct a preflight inspection of the aircraft as prescribed by the manufacturer. Renter shall use the manufacturer’s recommended pre-takeoff, cruise, and pre-landing checklist.
- Weather – Renter shall plan to operate the aircraft only when the present and forecasted weather indicate VFR weather conditions local and enroute – (generally ceiling of at least 3000 feet and visibilities of 7 miles or greater). IFR flight is allowed generally to avoid IFR hazardous weather conditions. No special VFR will be allowed in aircraft.
- All State, Federal and local requirements will be complied with by the renter.
- Takeoff and landing area – No takeoff or landing shall be made on any area other than the runways of an airport, designed, constructed, maintained and customarily used as an airport.
- Physical condition – Renter shall not operate the aircraft after he has used intoxicating liquor, tranquilizers, or sleep inducing drugs within 12 hours.
